Terms of Use

These terms govern your use of the EquiList platform (web app, mobile PWA, and API), operated by Lee Bliss T/A EquiList.app (UK sole trader, "EquiList", "we", "us"). By creating an account or using EquiList in the United Kingdom, you agree to these terms and to the Consumer Rights Act 2015 protections that apply alongside them.

1. The platform

EquiList is a marketplace and dispatch platform connecting horse owners with independent transport operators, a portal for vet practices to dispatch transport for their clients, and a classifieds service for buying and selling horses, property, horseboxes and tack (at /marketplace). We are not the carrier, seller, or buyer: every transport contract is between the owner and the chosen transporter, and every marketplace sale is between the buyer and the seller directly. EquiList verifies operator credentials, hosts the bidding/match flow, processes payments, provides the SOS dispatch infrastructure, and runs the marketplace listings & messaging — but is not a party to any sale or carriage contract.

2. Eligibility

You must be 18 or older to create an account. Transporters must hold a valid UK DEFRA Type 1 or Type 2 authorisation (per the Welfare of Animals (Transport) (England) Order 2006 / Wales / Scotland equivalents), current vehicle insurance, and care & custody insurance.

3. Owner obligations

  • Provide accurate horse information including medical conditions that affect transport.
  • Be present (or arrange a representative) at pickup and drop-off.
  • Pay the agreed bid amount or SOS escrow promptly via Stripe Checkout.
  • Use the SOS function only for genuine equine emergencies.
  • For Care Contacts: confirm a lawful basis to store their data under UK GDPR Article 6.

4. Transporter obligations

  • Maintain valid documents at all times — expired insurance auto-suspends your live status.
  • Complete Stripe Connect Express onboarding before accepting paid jobs.
  • Honour every accepted job; cancellations within 24 hours of pickup may incur platform penalties.
  • Travel safely, follow DEFRA welfare rules and Council Regulation (EC) 1/2005 (retained UK law).
  • Keep CCTV / fleet photos accurate.

5. Payments, escrow & subscriptions

Subscription tiers (GBP, ex VAT):

  • Solo — £1.95 / month — 5 ads. Includes a 90-day free trial; no card charged until day 91.
  • Yard — £4.95 / month — 20 ads. Billed immediately.
  • Business — £9.95 / month — 100 ads. Bidding & lead-inbox features unlock on business verification.
  • Cancel any time from /marketplace/billing.

Consumer Contracts Regulations 2013: UK consumers have a 14-day cooling-off period for new digital subscriptions. The period is waived automatically if you start using the service during that period (which posting an ad or using SOS counts as) — Regulation 36.

Escrow. Owners pay into Stripe Connect escrow; funds release on confirmed delivery, minus 8% (standard) or 12% (SOS) platform fee.

6. Marketplace rules

  • Accuracy: listings must accurately describe the item per the Consumer Rights Act 2015 s.50 (satisfactory quality) and the Sale of Goods Act 1979 s.13 (description).
  • Ownership: you must own (or be authorised to sell) anything listed.
  • Welfare: horses must be described accurately as to vices & behaviour; misrepresentation is grounds for takedown and may breach the Consumer Protection from Unfair Trading Regulations 2008.
  • No bulk scraping — automated harvesting prohibited.
  • Sellers may hide phone & email; numbers/emails in messages are auto-redacted to prevent off-platform fraud.

7. Liability

EquiList is provided "as is". Our liability is limited to the platform fees + subscription fees you've paid in the 12 months prior to the claim. Nothing in these terms limits liability for fraud, negligence causing personal injury, or any liability that cannot be excluded under UK law (Unfair Contract Terms Act 1977 / Consumer Rights Act 2015 s.65).

8. Governing law & dispute resolution

These terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the English courts. UK consumers may also use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

9. Changes

We may update these terms; material changes will be notified by email at least 14 days before they take effect. Pricing changes receive 30 days' notice — your current cycle is honoured at the existing rate.
