Terms of Use

These Terms of Use ("Terms") govern your use of the EquiList platform (web app, mobile PWA, and API) in the United States. The platform is operated by Lee Bliss T/A EquiList.app (a UK sole trader, "EquiList", "we", "us"). By creating an account or otherwise using EquiList you agree to these Terms.

1. The platform

EquiList is a multi-sided marketplace connecting horse owners and shippers with independent motor carriers of equines, a portal for veterinary clinics to dispatch transport for client horses, and a classifieds service. EquiList is not a motor carrier, freight forwarder, or broker as defined in 49 U.S.C. § 13102. We do not arrange transportation for compensation as a principal; the transportation contract is between the shipper and the carrier. EquiList provides verification, escrow infrastructure (via Stripe), and dispatch tooling only.

2. Eligibility

You must be 18 or older (or the age of majority in your state) to create an account. Carriers must hold:

  • Active USDOT registration with the FMCSA (verified at SAFER).
  • Where required for interstate for-hire transport, an active MC docket number under 49 U.S.C. § 13902.
  • USDA APHIS-issued Commercial Transporter registration where applicable to commercial intermediate handlers under 9 CFR Part 89.
  • Liability insurance per 49 CFR § 387 (minimum $750,000 for-hire interstate; higher for some commodities).
  • Care, custody & control insurance covering the animals in transit.
  • State CDL endorsements appropriate to vehicle weight class.

3. Shipper / owner obligations

  • Provide accurate horse information including medical conditions, Coggins / EIA test certificate (per state requirements), and Certificate of Veterinary Inspection (CVI) for interstate movement.
  • Comply with the federal Animal Welfare Act, 7 U.S.C. § 2143, and the 28-hour law (49 U.S.C. § 80502) governing rest stops for animals in interstate commerce.
  • Pay the agreed bid or SOS escrow promptly via Stripe Checkout.
  • Use the SOS function only for genuine equine emergencies.

4. Carrier obligations

  • Maintain valid USDOT / MC authority and required insurance at all times — expired authority auto-suspends Live status.
  • Complete Stripe Connect Express onboarding before accepting paid jobs.
  • Comply with the FMCSA Hours-of-Service rules (49 CFR Part 395) and the 28-hour livestock rest requirement.
  • Honor every accepted job; cancellations within 24 hours of pickup may incur platform penalties.
  • Maintain CCTV / fleet photos that accurately represent in-service equipment.

5. Payments, escrow & subscriptions

Stripe, Inc. processes all payments. By using EquiList you accept the Stripe Services Agreement. Prices are displayed in U.S. dollars (USD). Applicable state and local sales / use taxes may be added.

  • Solo — $2.49 / month — 5 ads. 14-day free trial.
  • Yard — $6.49 / month — 20 ads. Billed immediately.
  • Business — $12.99 / month — 100 ads. Bidding & lead-inbox unlock on business verification.
  • Standard transport escrow: 3.5% platform fee. Emergency SOS escrow: 4.5% platform fee.
  • Marketplace sales: 0% commission.

6. Marketplace rules & consumer protection

  • Listings must accurately describe the horse, property, vehicle, or item. The Magnuson-Moss Warranty Act and your state's Uniform Commercial Code Article 2 may impose implied warranties on sellers acting as merchants.
  • Sellers must own (or be authorized to sell) what they list.
  • Misrepresentation may violate state Unfair & Deceptive Acts and Practices (UDAP) statutes.
  • No falsified pedigrees, no live exports for slaughter, no unbroken horses sold as children's mounts.
  • Phone numbers and email addresses inside messages are auto-redacted to prevent off-platform fraud.

7. DMCA notices

If you believe content on EquiList infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to support@equilist.app with subject line "DMCA Notice". Our designated DMCA agent will respond promptly.

8. Limitation of liability

EquiList is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. In no event will EquiList's aggregate liability arising out of these Terms exceed the platform fees and subscription fees you paid in the 12 months immediately preceding the claim. Some U.S. states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless EquiList, Lee Bliss, and our service providers from any claim, demand, loss, or damages arising out of your use of the platform, your breach of these Terms, or your violation of any law or third-party right.

10. Governing law & arbitration

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of these Terms will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules in Wilmington, Delaware. You and EquiList each waive any right to a jury trial and to participate in a class action. You may opt out of this arbitration clause within 30 days of first accepting these Terms by emailing support@equilist.app with subject "Arbitration Opt-Out".

11. Changes

We may update these Terms; material changes will be notified by email at least 14 days before they take effect. Pricing changes receive 30 days' notice — your current billing cycle is honored at the existing rate.
